Thank you for choosing our farming rental service. The Kiawe Rental Protect Plan is offered to provide you, our valued customer, with protection against the significant costs of accidental damage or theft of the rented equipment. This plan is not insurance, but an agreement between you (the "Renter") and us (the "Company") to limit your financial responsibility for covered incidents.
Participation in this plan is optional, but highly recommended. The fee for the Kiawe Rental Protect Plan will be detailed in your rental agreement.
This plan covers the repair or replacement cost of rented equipment in the following situations:
Accidental Damage: Unforeseen damage that occurs during the normal and intended operation of the equipment. This includes, but is not limited to, collisions, drops, and other operational mishaps.
Theft: Loss of equipment due to theft from a secured location. A police report is required for all theft claims.
Vandalism: Malicious damage to the equipment. A police report may be required.
Fire: Damage due to fire, provided it was not caused by negligence or intentional misuse.
This plan does not cover the following:
Normal Wear and Tear: Expected deterioration of the equipment from normal use, such as tire wear, scratches, or minor dents that do not affect the equipment's functionality.
Negligence or Misuse: Damage resulting from improper use, abuse, or failure to follow the operating instructions. This includes overloading the equipment, using the wrong fuel or lubricants, or any use that goes against the manufacturer's specifications.
Damage to Consumable Parts: Damage or loss of tires, tubes, blades, belts, and other parts expected to be replaced during the equipment's life.
Mysterious Disappearance: Loss of equipment that cannot be explained or is not reported as theft to the police.
Damage from Natural Disasters: Damage caused by floods, earthquakes, hurricanes, or other acts of God, unless specifically covered in your rental agreement.
Damage to a Third Party: This plan does not cover injury to people or damage to property other than the rented equipment.
To ensure the validity of this protection plan, you agree to:
Operate Safely: Use the equipment in a safe and responsible manner, according to the provided operating instructions.
Secure the Equipment: Store the equipment in a locked or secure location when not in use to prevent theft.
Perform Daily Checks: Conduct basic daily maintenance checks as outlined in the user manual (e.g., checking fluid levels, tire pressure).
Report Incidents Promptly: Notify us immediately of any accident, damage, or theft. For theft or vandalism, you must also file a police report within 48 hours.
In the event of an incident, please follow these steps:
Ensure Safety: Make sure the area is safe and there are no immediate dangers.
Contact Us: Call our office immediately to report the incident. Provide your name, rental agreement number, and details of what happened.
Document the Scene: If possible, take photos of the damage and the surrounding area.
File a Police Report (if applicable): For theft or vandalism, obtain a copy of the police report and provide it to us.
We will then assess the situation and guide you through the next steps for repair or replacement.
Even with the Kiawe Rental Protect Plan, you have a financial responsibility. In the event of a covered incident, you will be responsible for paying a deductible. The deductible amount is the lesser of:
• 15% of the total repair cost, OR
• $250.00 USD
This deductible must be paid before the equipment is repaired or replaced.
• The Kiawe Rental Protect Plan is not an insurance policy and does not provide liability coverage.
• This agreement shall be governed by the laws of the State of Hawaii.
• The Company reserves the right to decline a claim if it is determined that the damage or loss was due to actions not covered by this plan, including but not limited to gross negligence or intentional misconduct.
• This document is a summary of the plan. The full terms and conditions are detailed in your rental agreement.
